Terms of Use

1. Agreement to Terms

By accessing or using ExamPat (the “Service”), available at exampat.com, you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Service. The Service is operated by Futurist IP, an Ontario corporation incorporated under the laws of the Province of Ontario, Canada (“Company,” “we,” “us,” or “our”).

2. Eligibility

The Service is intended for use by professionals and individuals who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We do not knowingly provide the Service to anyone under 18.

3. Description of the Service

ExamPat is a data analytics platform that provides structured information and analytics related to United States Patent and Trademark Office (USPTO) ex parte reexamination proceedings. The Service aggregates publicly available patent data and presents it through searchable, filterable interfaces and visualizations.

4. Accounts & Registration

Certain features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Paid Subscriptions & Billing

Certain features of the Service may require a paid subscription. If you purchase a paid plan, you agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable except where required by applicable law or as otherwise stated at the point of sale. We reserve the right to change our pricing at any time; however, any price changes will not apply to your current billing period. If you do not agree with a price change, you may cancel your subscription before the next billing cycle. We may use third-party payment processors to handle transactions; your use of those services is subject to their respective terms and privacy policies.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
• Use automated tools, bots, scrapers, or similar means to access or collect data from the Service without our prior written consent.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or the servers or networks that host it.
• Resell, redistribute, or commercially exploit the Service or any data obtained from it without our prior written consent.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, design, and software — are the exclusive property of Futurist IP or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. Nothing in these Terms restricts your rights to the underlying publicly available USPTO data.

8. Data Accuracy & Disclaimer

The data and analytics provided through the Service are derived from publicly available sources. While we strive for accuracy, we do not guarantee that the information is complete, current, or error-free. The Service is provided for informational and analytical purposes only and does not constitute legal advice. You should not rely on the Service as a substitute for professional legal counsel.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUTURIST IP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Indemnification

You agree to indemnify and hold harmless Futurist IP and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.

12. Service Modifications

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect your use of the Service. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Modifications to Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the effective date above. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Futurist IP regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
